Welche Rechte haben Eltern und Schüler?

 Die Lernmittelfreiheit wirft in der praktischen Umsetzung an den Schulen vor Ort im-mer wieder Fragen auf, die in dieser Broschüre beantwortet werden sollen. 

  • Wie weit reicht die Lernmittelfreiheit? 
  • Welche Rechte ergeben sich daraus konkret? 
  • Welche Gegenstände müssen die Eltern trotz der Lernmittelfreiheit selbst be-zahlen? 
  • Nach welchen Regeln können Eltern an den Kosten beteiligt werden? 

Lernmittelfreiheit und Schulgeldfreiheit: Was ist der Unterschied?

Die Schulgeld- und Lernmittelfreiheit sollen der Bildungsgerechtigkeit dienen. Der Zugang zu Bildung soll nicht von den finanziellen Möglichkeiten der Eltern abhängen. 

Deshalb darf für den Unterricht an den öffentlichen Schulen kein Entgelt verlangt werden. Diese Vorgabe wird als Schulgeldfreiheit bezeichnet. Ausgeschlossen ist damit aber nicht, dass die Kosten für außerunterrichtliche Veranstal-tungen, z. B. Schullandheim oder Studienfahrten, von den Eltern zu tragen sind.

Artikel 14 
(2) Unterricht und Lernmittel an den öffentlichen Schulen sind unentgeltlich. Die Unentgeltlichkeit wird stufenweise verwirklicht. 

Die Lernmittelfreiheit stellt sicher, dass alle Schülerinnen und Schüler die für den Unterricht notwendigen Lernmittel erhalten und diese Ausstattung nicht von den finanziellen Möglichkeiten ihrer Eltern abhängt. 

Lernmittel werden leihweise oder zum Verbrauch überlassen - aber immer unentgeltlich

Die wichtigsten rechtlichen Bestimmungen zur Lernmittelfreiheit sind in der Landesverfassung (Artikel 14 Absatz 2) sowie im Schulgesetz (§ 94) zu finden. Diese Bestimmungen räumen den Schülerinnen und Schülern bzw. den Eltern das Recht ein, dass ihnen die notwendigen Lernmittel „leihweise“ überlassen werden. 

  • Das bedeutet zum einen, dass die Lernmittel „unentgeltlich“ zu überlassen sind. Dies ergibt sich aus der gesetzlichen Definition der „Leihe“ (§ 598 BGB). 
  • Zum anderen bedeutet das aber auch, dass die Lernmittel wieder zurückzugeben sind, z. B. wenn das Schuljahr zu Ende ist, in dem ein Schulbuch zum Einsatz kommen soll. 

Es gibt keine rechtliche Regelung, nach der die leihweise Überlassung von einer Kaution abhängig gemacht werden dürfte. Sie ist deshalb unzulässig. 

Bei manchen Lernmitteln ist aber eine Rückgabe nicht möglich, weil sie vom Schüler „verbraucht“ werden. Sie können deshalb auch nicht leihweise, sondern zum Verbrauch überlassen werden. Dies betrifft z. B. Bastelmaterial, das von dem Schüler verarbeitet wird, kann aber auch z. B. ein Workbook oder eine Ganzschrift betreffen, in die von dem Schüler auf Anweisung der Lehrkraft Eintragungen, Anmerkungen oder Unterstreichungen vorzunehmen sind. 

Was sind Lernmittel?

Lernmittel sind vor allem Schulbücher, aber auch „andere Sachen, die dazu bestimmt sind, von Schülerinnen und Schülern zum schulischen Lernen genutzt zu werden“. 

Zu den Lernmitteln gehören deshalb auch sog. Ganzschriften (Literatur in Form von Romanen, Novellen oder Dramen) oder Arbeitshefte sowie Lern- und Arbeitsmaterialien, Taschenrechner, Musikinstrumente oder Zirkel aber auch die oben angesprochen verbrauchbaren Lernmittel. 

Nicht unter die Lernmittelfreiheit fallen Gegenstände, „deren Verwendung die Schule dem Schüler freistellt, auch wenn sie nützlich oder üblich sind (z. B. Ranzen, Rucksack, Mäppchen), oder die der Schüler typischerweise „ohnehin“ besitzt (z. B. Sport- oder Schwimmkleidung), so der Verwaltungsgerichtshof Baden-Württemberg in seiner Entscheidung vom 23.01.2001 (9 S 331/00). 

Nur notwendige Lernmittel müssen überlassen werden!

Der Anspruch auf ein Lernmittel besteht aber nicht für alle nützlichen Lernmittel, wie z. B. zusätzliche Arbeitshefte. Nur wenn sie „notwendig“ sind, werden sie leihweise oder zum Verbrauch überlassen. 

Die notwendigen Lernmittel ergeben sich zum einen aus einer offiziellen Liste, dem Lernmittelverzeichnis, in dem für die Schularten, Fächer und Klassenstufe die notwendigen Lernmittel aufgeführt sind. 

Sind Lernmittel in dieser Liste nicht aufgeführt, können sie trotzdem „notwendig“ sein, wenn sie in der Klasse nach den Vorgaben der Fachkonferenz (alle Lehrkräfte, die ein bestimmtes Fach unterrichten) oder – sofern keine Fachkonferenz besteht – von der Schulleiterin/ dem Schulleiter nach Anhörung der Fachlehrerinnen und Fachlehrer entsprechend bestimmt wurden. 

Hier kommt es also darauf an, ob z. B. ein Arbeitsheft von der Lehrkraft nur als Ergänzung zum Unterricht „empfohlen“ wird (dann kein notwendiges Lernmittel) oder aber das Arbeitsheft im Unterricht Verwendung finden soll (dann notwendiges Lernmittel). 

Die Ausnahme von der Lernmittelfreiheit: Gegenstände geringen Werts

Gegenstände geringen Werts sind von der Lernmittelfreiheit ausgenommen (§ 94 Abs. 1 Satz 1 SchG). Dieser sogenannte unbestimmte Rechtsbegriff ist von den Schulträgern in eigener Zuständigkeit auszulegen. Der Verwaltungsgerichtshof sieht in der Ausnahme der „Gegenstände geringen Werts“ eine reine Bagatellgrenze, die für den bis Ende 1981 erreichten Stand von damals 1 DM je einzelnes Lernmittel anhand der Entwicklung der allgemeinen Lebenshaltungskosten fortgeschrieben werden kann. 

Die Auslegung sollte an der konkreten Situation gemessen werden, bei der beispielsweise Berücksichtigung findet, wie oft die Betroffenen den Bagatellbetrag zu erbringen haben. Dies kann je nach Schule, Schulart oder Klassenstufe sehr unterschiedlich sein. Durch den VGH Mannheim wurde im o. g. Urteil entschieden, dass die in diesem Verfahren streitige Ganzschrift im Wert vom 9,90 DM kein Gegenstand geringen Werts ist.

Im Rahmen der Auslegung des Begriffs „Gegenstände geringen Wertes“ können vom Schulträger auch solche Gegenstände von der Lernmittelfreiheit ausgenommen werden, bei denen die Möglichkeit oder Gefahr des Missbrauchs oder der Verschwendung besteht oder deren Beschaffung bzw. Kostenerstattung einen Verwaltungsaufwand verursacht, der in keinem Verhältnis zum Zweck der Lernmittelfreiheit steht. 

Unter die Ausnahme „Gegenstände geringen Werts“ können vom Schulträger somit insbesondere Schreib- und Malgeräte (auch Farbkasten), Papier, Hefte und Ordner gefasst werden. Solche Gegenstände sind von den Erziehungsberechtigten oder den Schülerinnen bzw. Schülern selbst zu beschaffen. 

Es gibt keine verpflichtende Eigenbeteiligung der Eltern!

Die Regelung, dass Gegenstände von geringem Wert nicht unter die Lernmittelfreiheit fallen, bedeutet nicht, dass bei teureren Lernmitteln, die mehr als nur geringen Wert haben, generell ein Eigenanteil verlangt werden könnte. Fallen Lernmittel unter die Lernmittelfreiheit, weil sie mehr als nur geringen Wert haben, werden die Kosten grundsätzlich vollständig vom Schulträger übernommen, ohne Eigenbeteiligung der Eltern. 

Ist es dann generell unzulässig, bei den Eltern einen Kostenbeitrag einzusammeln?

Soweit es um Lernmittel geht, die unter die Lernmittelfreiheit fallen, ist eine solche Umlage unzulässig. Dies gilt also auch für Verbrauchsmaterialien (z. B. Bastelmaterial), sofern ihr Wert jeweils über der genannten Geringfügigkeitsgrenze liegt. 

Eine solche Umlage ist aber möglich z. B. für die Kosten von Schulausflügen, die von den Eltern selbst zu tragen sind. 

Selbstbeschaffung und „Bonussystem“ auf freiwilliger Basis möglich

Lernmittel können auf freiwilliger Basis auch von den Eltern selbst beschafft werden und somit in das Eigentum der Schülerinnen und Schüler übergehen. Häufig wird hier das sogenannte Bonussystem angewendet, bei dem sich der Schulträger finanziell an der Beschaffung beteiligt. 

Die Eltern müssen aber stets die Wahlfreiheit haben, d. h., es muss immer klar sein, dass sie sich für die leihweise Überlassung des Lernmittels entscheiden können, ohne dass damit irgendwelche Nachteile für ihr Kind verbunden sind.

Ein Beschluss der Klassenkonferenz vermag die Eltern in keiner Weise zu binden. Nur die individuelle Entscheidung der Eltern ist maßgeblich. 

Wer bezahlt die Lernmittel?

Das Land trägt die Personalkosten der Lehrkräfte, die kommunalen Schulträger alle übrigen Schulkosten, also auch die Kosten für die Lehr- und Lernmittel. Zumeist erhalten die Schulleitungen vom Schulträger ein Budget, aus dem sie die notwendigen Anschaffungen bestreiten können. 

Der Schulträger kann nicht selbst bestimmen, welche Lernmittel „notwendig“ sind. Diese Entscheidung obliegt der Fachkonferenz bzw. den Lehrkräften. Allerdings muss die Schule bei ihren Entscheidungen beachten, dass der ihr zur Verfügung stehende Etat nicht überschritten wird. 

Der Schuletat ist Teil des Haushalts der Gemeinde, dessen Höhe vom Gemeinderat beschlossen wird. In welcher Höhe der Schule Mittel zur eigenen Bewirtschaftung zugewiesen werden, ist vom Schulträger zu entscheiden. Hierbei ist auch zu berücksichtigen, welche Gegenstände von der einzelnen Schule in eigener Zuständigkeit beschafft werden und welche vom Schulträger selbst. Da es sich hierbei um eine Angelegenheit der kommunalen Selbstverwaltung handelt, besteht keine Vorgabe durch das Land, in welcher Höhe Mittel zur Verfügung zu stellen sind. Eine solche wäre auch nicht sinnvoll, da die Kostenstruktur von Schule zu Schule unterschiedlich ist. 

Welche Ansprüche haben Eltern und Schüler?

Liegen die Voraussetzungen der Lernmittelfreiheit vor, besteht ein individueller Anspruch der Schülerin oder des Schülers gegenüber dem Schulträger auf Beschaffung des Lernmittels. Diese Pflicht des Schulträgers zur Gewährung der Lernmittelfreiheit besteht unabhängig davon, ob die Schule hierfür noch Mittel in ihrem Budget hat. Allerdings muss die Schule darauf achten, dass sie ihr Budget nicht dadurch überschreitet, dass sie zu viele Lernmittel als notwendig erklärt. 

Im Rahmen der gesetzlichen Vertretung ihres Kindes können die Eltern den individuellen Anspruch der Schülerin oder des Schülers gegenüber dem Schulträger auf Beschaffung des Lernmittels geltend machen. 

Das Schulgesetz (§ 56 Abs. 1 Nr. 5 SchG) sieht die Unterrichtung und Aussprache über in der Klasse verwendete Lernmittel einschließlich Arbeitsmittel im Rahmen der Klassenpflegschaft vor. Die Klassenpflegschaft kann bei Meinungsverschiedenheiten über Lernmittel, die nicht dem Zulassungsverfahren des Kultusministeriums unterliegen, die Schulkonferenz zur Vermittlung anrufen (§ 56 Abs. 2 SchG). 

Weiter kann die Elterngruppe der Klassenpflegschaft der Klassenkonferenz Vorschläge zur Beratung und Beschlussfassung vorlegen (§ 56 Abs. 6 SchG). 

Welche Rolle hat der Elternbeirat?

Dem Elternbeirat hat die Aufgabe, an der Verbesserung der äußeren Schulverhältnisse – somit auch der sächlichen Ausstattung – mitzuarbeiten (§ 57 Abs. 1 Satz 2 SchG). Er soll Anregungen aus Elternkreisen, die von allgemeiner Bedeutung sind, beraten und an die Schule weiterleiten, für die Belange der Schule beim Schulträger eintreten, soweit die Mitverantwortung der Eltern es verlangt, und an der Beseitigung von Störungen der Schularbeit durch Mängel der äußeren Schulverhältnisse mitwirken. (§ 57 Abs. 1 Satz 4 Nr. 2, 4 und 5 SchG)

Dabei wird der Elternbeirat von der Schule und dem Schulträger beraten und unterstützt. Der Schulleiter unterrichtet den Elternbeirat über seine Rechte und Pflichten sowie alle Angelegenheiten, die für die Schule von allgemeiner Bedeutung sind und erteilt die notwendigen Auskünfte. Ist also z. B. das Schulbudget nach Auffassung des Elternbeirats zu knapp bemessen, kann auch er sich beim Schulträger für eine Erhöhung einsetzen. 

Nach der Elternbeiratsverordnung obliegt es dem Gesamtelternbeirat Fragen zu beraten, die alle Eltern an öffentlichen Schulen desselben Schulträgers berühren (§ 30 Nr. 1). 

Die Rechte der Elternvertreter umfassen jedoch keine Weisungsrechte gegenüber Schulleitung oder Behörden (§ 4 Elternbeiratsverordnung).

Welche Rolle hat die Schulkonferenz?

Die Schulkonferenz ist paritätisch besetzt, d. h., es sind gleich viele Vertreter der Eltern, der Lehrkräfte sowie der Schülerinnen und Schüler. 

Die Schulkonferenz entscheidet über die Anforderung von Haushaltsmitteln gegenüber dem Schulträger (§ 47 Abs. 3 Nr. 7 SchG) ; dabei bleibt die Haushaltshoheit des Schulträgers jedoch unberührt. Auch ist die Schulkonferenz anzuhören zu der Verwendung der der Schule zur Verfügung gestellten Haushaltsmittel im Rahmen ihrer Zweckbestimmung sowie Lernmittelfreiheit in der zu Stellungnahmen der Schule gegenüber dem Schulträger zur Ausstattung und Einrichtung der Schule (§ 47 Abs. 4 Nr. 1b und 6 SchG).
